I bought a .com domain name for my project and registered a company under the name. I then found a small company that uses the same name but under a .biz domain. The company does not use ‘tm’ symbols, and they are not a legal entity, they are DBA (doing business as). The domain name is not a common word, and can be trademarked. In fact, it was trademarked but canceled 10 years ago. Can I trademark the name now? I don’t mind that small company using it. Also, can the company go after me for ‘violating their’ trademark? I repeat – they don’t seem to be protective of the use of the name.

i want to start an online business and this will be a part time thing, should i trademark my logo and domain/business name if i’m not even sure the business will be a success?
i would also like to know if i don’t register the name/logo, can someone else do it and sue me after i already started the business?

theres is a popular online show , podcost that is produced by a pretty well known company, now my domain name and my llc name will be exactly the same, as far as i know, the name is not registered on federal level. is that legal? is a name of the show considered to be a trademark its self?

Here is my hypothetical. Can I register a domain and use it to sell a book titled the “Truth About McDonalds” or “Behind the Big Mac”?
What are my limitations for selling something and using another company’s trademarked brand in titles and statements?

For instance, if I owned “Whazzup” as a trademark, could I stop the person who owns “Whazzup.com” from using the name?
If so how? And is there any way I can acquire Whazzup.com from them legally?
What if also the trademark was registered after the domain name was? Does that void it?

I want to create a website about many of my favorite animated Disney characters and post many pictures of those characters on my site, with a domain name that would include the word Disney.
Am I allowed to do this or would I possibly be facing some legal issues with Disney?
Who should I contact regarding this? I can’t seem to find any legal information or contact information for Disney.
Does anyone have any insight on this or any suggestions?

This is a unique Poster I realized with Publisher.
There is no pictures but only data on this poster, numbers and words. It’s in black in white. I would like to sell this poster but I would like to protect my idea because it’s kind of easy to be copied.
The name of this poster is very descriptive, should I trademark the name. I already own a bunch of different domains in relation to this product.

if goes to a non functioning website or one that looks like the original owner is not doing anything or abandoned it. I am going back and forth on this one. Should i order nondashed domain name(i already did) but then found out someone had the same domain name with dashes. The site the owner has a domain name for was updated in Sept 09 and was originally bought in 2002 but after looking at the site it does not look like its selling anything just a canned site that was started and never finished. I think the owner is not under the assumption that the site domain name is on auto renew. I don’t want to mention the site so as not lose control of my domain name. If anyone has any take on this please let me know. Question should i keep the nondashdomain name trademark as don’t think the dashed name is, or go and get another name.
