I am curious if one could likely avoid legal issues by simply registering and selling (basically flipping) a television show title based domain name using the .tv domain extension. This seems to be more of a trademark issue than a copyright one. To give a hypothetical example. Many such shows have already been registered as .tv domain names, i.e. “ilovelucy.tv” “matlock.tv” “greenacres.tv” Many high profile and popular names have not been registered. In all the previous examples given, the domains are “parked” and very likely not registered to the production company that owns the actual show content. Nor are the domains being used to directly promote the television program through references to it, or content from the shows displayed on the parked domain. Could someone successfully register such a domain, and as long as they do not directly promote the television show or refer to it while owning and “parking” the domain, then sell it in an auction or open market for domains to someone else (willing to buy it) without likely running into infringement issues?
One of my friend’s bands was just signed by interscope records, and I am creating his website for him. No one really knows about it yet, as he has not released anything, which is why (I assume) that I can register the band name as a domain for only $3 a year (and I’m willing to pay up to $50 if necessary).
But lets jump the gun and say that the group really does make it, and people want to establish a fan website or whatever. Will the people who I bought the domain name from take bids from the other people in which my name will always be up for auction?
And if this would be defined in the contract/user agreement, what terms should I look for?
Thanks!
Thanks; I forgot what website it was, but I was looking at the prices earlier and when I saw that one domain was taken, next to it it said “make bid.”
As a prerequisite to using Google Apps you will need to have registered your own internet domain name. This video walks you through the process of registering a domain with Godaddy for use with Google Apps.
the affiliate is using the exact same domain name as me, except he has put in a dash ie – between the two words of the domain. he is selling my product. if i decided to register the trademark, could i have a claim against him?
