I know the Anticybersquatting Consumer Protection Act applies to trademarked names, but if the title of the book is not trademarked (only copyrighted), then does the act still apply? Or is there another similar act that applies to copyrights?

My friend used a friend to buy their domain name for their website (the business owner’s name) and after the friendship went south the friend stopped paying the domain fees. Now my friend’s has lost their website and when you try and visit the site it says it is parked courtesy of Godaddy.com. When I went to the website it says the domain is waiting for the customer to cancel or renew the subscription. Since I know this isn’t happening how can I go about purchasing his site back and making sure it is in his name, so it doesn’t happen again?

So like if i got a domain name thats not a trademark and someone else likes the name,So they trademark it because it was never a trademark. Could they sue or go after me for anything?

I bought 2 domains on 1&1 and have them hooked up to Sedo. Do I have to tell someone to buy them via Sedo or can I just somehow sell them more manually. How does the transfer process work?
Also how would this work if I sell on eBay?

I have a trademark for a business name, and someone owns the .COM to it! WTF!!! I don’t have the $10,000 they are asking for. Should I get a lawyer?

If you register a trademark, and someone else already has the trademarked word as a domain name (theword+.com) can you file an action to get the domain name?
Does it matter that the domain name owner has registered his domain name before you registered your trademark?
(I know it looks like I’m looking for legal advice but I juest need to get an idea about the situation – I’m a law student myself.)

and if that is possible, can we consider this a loophole towards attaining a domain that is inactive and the owner does not want to part with.

I thought of a word/term (not going to say what it is)
two words combined
saw nothing on google for it
got a doman name. com with that word
guy calls me after finding it on domainsearch.com
wants to buy domain I say no
stupid tucows (known to have major problems) did not renew it and stupid me did not think I lost it because they never emailed me
Now this person claims on their wikipedia in their new published book they coined the term.
I have proof through history of domains I had it first
Verizon can probably show they called me and I can go back on record
for 15-30 minutes we were on the phone HE ADMITTED he just thought of the name, then searched for a domain, saw I had it
Do I have any rights here? Should I sue or what should I do?
I feel like he used me in the conversation, stole my idea and is claiming lies. He didn’t coin it, he thought of it and saw I had it first and offered to buy it and I said no. – I dont have a recorded convo, but the phone company can possibly prove he called me before he did the book
