Could I register a Federal TradeMark, and then go sue the person who has a .com with the trademark name in it then sue them for trade mark infringement and force them to turn over the domain? I know it sounds preposterous, but according to our stupid trademark infringement laws this might seem legal.
What if they had the domain registered before I had the trademark?
And, what if they already have the domain, then I register the federal TM, but then their domain expires, then they renew it, then technically they registered a domain AFTER I owned the trademark, thus making it trademark infringement.
I’m tired of people bullying me out of domains that only have ONE word out of their multi word trade mark, so I’m just seeing if there is any way to “give back to the community” exploiting our beloved US laws.
I don’t know how kMART.com got away with it without infringement with walMART.com because they both provide the same service.
More details.. let me reiterate the fact that the website I would be trying to legally take over does NOT have any trade mark on the words used in their domain.
Ex. some body buys ILOVEFUZZYCATS.com, but doesnt own a trade mark.. they just run their own little website.
Then I go trademark the name (”ILOVEFUZZYCATS”). Could I then sue them for TM infringement and have their domain taken away?

Okay, so pretty much the most of this huge company/site’s trademarks are now dead/abandoned according to the registry.
They have 200+ million users, and are a HUGE site worldwide…so their name is valuable to them.
Would I be able to hire a patent/trademark lawyer, and ’steal’ these from them like a domain, since they expired? Then would I be able to sue the company for tons of money for continuing to use them?
I’m just curious how this would work legally.
It seems practical, and legal.
Their comp nay name expired last year, and most of their other 100 trademarked words just expired n January. Non have been re-registered yet.
When I said this site, I’m not talking about Yahoo XD
I’m talking about another site that was sold a while back for half a billion dollars. lol
I’m not actually going to do this. I’m just curious how it would work out if I did.
I actually do own a very similar site, which I could use to cover up my reason for the trademark?
Then I could be exploitative later ^_^

I’ve been notified by another company’s law firm that my business name is infringing on their trademark. Most of my business is generated online and the domain name bears the name that’s trademarked.
How can I change the domain name without losing business? Does anyone know if I can redirect the domain name to another site? Is that possible? Or do I have to give up the domain name altogether?

How can I search it from a reliable website? like searching for available domain by going to godaddy.com.
I want to make a forum website for my school but I’m afraid to use its name on my domain name because of trademark issues. If I make such website, am I going to be in trouble. I know that TM is a naughty area and I don’t want to get involved in any illegal activity. Its going to be a helpful website btw. I believe that they have trademark for their logo and name(–not sure).can i open a website named tccdforum.com(”tccd” or “tarrant county college district” is the school’s name) ? Am I going to be in trouble by using that name? can you please check and let me know if they really have a trade mark ?

Trademark for use or not?
I want to make a forum website for my school but I’m afraid to use its name on my domain name because of trademark issues. If I make such website, am I going to be in trouble. If I want to use a domain name, but part of it already has a trademark, then would I be infringing on the trademark by using the domain name to sell clothing?
Example: blue collar nation has a trademark
But if I have the domain name bluecollarnation.com, and I sell clothes labeled bluecollarnation, would that be considered infringement or dilution?

Basically, we received a letter from a company that has the same name as ours and are alledging trademark infringement. They are based out of Texas and have a plant in Rice Lake, WIsconsin and we are in Milwaukee, WIsconsin—we are very far away from eachother…but we have completely different products/services. They manufacture window and door components (parts on the windows) and we install windows, siding, and doors. They sell products we offer a service. Also, they want the right to our domain name. Is this trademark infringement since we offer two different products/services or do we have to surrender or name and domain?Please help fast! Can you give me any advice on what I should do?
We have not been operating longer than they have, but our clients are two different types, we sell to homeowners, they sell components of the window itself to window manufaxturers.

I bought a .com domain name for my project and registered a company under the name. I then found a small company that uses the same name but under a .biz domain. The company does not use ‘tm’ symbols, and they are not a legal entity, they are DBA (doing business as). The domain name is not a common word, and can be trademarked. In fact, it was trademarked but canceled 10 years ago. Can I trademark the name now? I don’t mind that small company using it. Also, can the company go after me for ‘violating their’ trademark? I repeat – they don’t seem to be protective of the use of the name.

i want to start an online business and this will be a part time thing, should i trademark my logo and domain/business name if i’m not even sure the business will be a success?
i would also like to know if i don’t register the name/logo, can someone else do it and sue me after i already started the business?
