Usually a Google search will reveal if someone is already using the name I want. But in this case it’s inconclusive. There is a company with that name, but their website is in the .tk domain and seems to be squatted on and unrelated to the company. They also have a (down/expired) website in the .cjb.net domain (cjb.net seems to be a registrar).
The .com for that name sends me straight to a registrar.
There are a few other Google hits for it but they all seem to be 404′d or squatted on. Does that mean I can use this name? Where do I go to find out if it’s been trademarked or copyrighted already?
I meant the name of my company, of which I would lease the corresponding domain. I want to trademark a company name.

There’s a certain fictional character whose name I want to use as part of a legal company name ([name] Enterprises, or whatever). The character appeared in a story dated 1927, so the copyright will be expiring soon. Once it does, can I legally use this name as a part of a business name?

Would it be copyright infringement to use a trademarked name in part of a domain name for a web site? The name I am considering using is a made up name of a character. A similar example would be ‘Shrek’, the animated character in the movie of the same title. It would be used in conjunction with other non-trademarked words, an example being www.shrekforthewin.com. The service I would be providing is in no way related to the actual character, though I do not know if that would make a difference. Does it change things if I would be making some money through advertisements and endorsements on the site?

lets say i own “greenhat.com” and then someone decides to create a business called GreenHat and trade marks it- can they take me to court to get that domain name – or – do they have to buy it from me to get it?

I have a Trademarked Domain name for example lets call it www.Kitty.com Some one has taken the domain name and has just added “THE” to the front “example” www.TheKitty.com The Impostor website has the same kind of content as mine does. This person has been known for stealing from other websites and i know for a fact they purposely did this.

I’m working on a fee-based online puzzle web site called emindquizzes.com (an hypothetical example). mindquizzes.com is owned by a company called “Mind Quizzes” that sells board games. The company name was trademarked before I obtained my domain. Am I risking to have trademark infringement issues by using emindquizzes.com for my business? Thanks a lot.

Hi, I just recived a mail from the trademark owner from my domain name.He is offering me some $500 for the domain name. I did not use the website for commercial interest, parked free. Does the company has the rights to obtain the domain name via USRP?
